Acceptance of Terms
Your access to and continued use of The Manitoba Public Insurance Corporation (“MPI”) MyMPI website at www.mympi.mpi.mb.ca (the “Site”) constitutes your acceptance and compliance with the following Terms of Use. If you are entering into these Terms of Use on behalf of an organization, you represent that you have the authority to bind such organization and its users to these Terms of Use. If you do not agree to these Terms of Use, you should immediately discontinue any use of the Site.
Purpose
The Site provides a channel for you to conduct business with MPI, along with other relevant information related to MPI, and the interactions you have with MPI, or the services MPI provides to you.
The Site is not intended to provide legal advice, and is not to be relied upon as binding in any dispute, claim, action, demand, or proceeding of any kind involving MPI. You should consult The Manitoba Public Insurance Corporation Act, The Highway Traffic Act, and The Drivers and Vehicles Act, together with their accompanying regulations, along with any other applicable legislation for the interpretation and application of the law. If there is any omission from the Site, or any contradiction or difference between the Site and any statute or regulation, you must treat the statute or regulation as the full and correct statement of your rights and obligations at law.
Change to these Terms and the Site
You accept that these Terms of Use may be changed from time to time and that any changes will be binding upon you. You agree that it is your responsibility to check for any changes to these Terms of Use. The most recent revision date for these Terms of Use is shown above.
MPI may at any time for any reason add, remove, or modify any Information on the Site and/or the functionality of the Site.
Verification Required
MPI may limit your access and use of the Site until certain verification steps have been fulfilled and based on the user role assigned to you by MPI.
Electronic Communications
You consent and agree that MPI may send electronic communications including notices to you through the Site, or through email if you provided your email address and consented to such contact. You will be deemed to have received an electronic communication or email on the day it was sent. You accept all risks associated with such electronic communications, including all security, accessibility, and reliability risks. You may opt out of receiving emails that include an unsubscribe function however, emails about your account or transactions conducted through your account will continue to be sent.
Copyright, Trademarks, and Your Limited License to Use the Information and the Site
Copyright to the Site is owned by MPI. All rights are reserved. MPI either owns the intellectual property rights to or has acquired the necessary licences and permission to use the information on the Site, including all text, code, videos, sounds, images, graphics, and the selection and arrangement of the contents of the Site etc. (collectively called the “Information”).
Certain words, phrases, names, designs or logos used on the Site may constitute trademarks, service marks, or trade names of MPI or other entities (collectively called “Trademarks”).
Except as expressly provided, nothing herein, or within the Information or the Site shall be construed as granting to you any license or any intellectual property rights in the Information or Trademarks. You are not permitted to use or change the Information or Trademarks without the prior written consent of MPI, or the other applicable entities, as the case may be.
Subject to the rest of these Terms of Use, upon creation and validation of your Account by MPI, you are granted a revocable, limited, non-sublicensable, non-transferable, and non-exclusive licence to:
- access and use the Site; and
- display or print short extracts of the Information, provided the Information is not changed in any way
only for the purposes related to the interactions you have with MPI, or the services that MPI provides to you on the Site (the “Permitted Uses”).
You will be fully responsible for any consequences resulting from your use of the Site, and you must keep intact all copyright, trademark, and other proprietary notices. Any other use of the Information or the Site outside the Permitted Uses is prohibited. None of the Information may be otherwise reproduced, republished, re-disseminated, modified, adapted, altered, or changed in whole or in part, in any manner or form without the prior express written consent of MPI. Republishing and reproducing includes any uploading, downloading, or accessing the Information on the Site onto the Internet or any device. MPI reserves the right to require that you delete, destroy or otherwise remove any Information that is used in a manner that, in the opinion of MPI, is contrary to these Terms of Use, any other agreements between you and MPI, or is otherwise inappropriate, derogatory or offensive.
Account Security
Your account, username, password, or any other security feature for the Site (collectively called “Credentials”) must meet the requirements for length, expiration time period, and complexity set by MPI.
You are solely responsible for all actions taken using your account and the confidentiality of your Credentials. You must exercise caution when accessing your account from a shared computer so that others are not able to access or use your account. You must use your computer’s software lock feature to lock your computer or log out of the Site prior to leaving your computer.
User Code of Conduct
You will:
- use the Site in accordance with these Terms of Use, the Permitted Uses, and all applicable laws;
- keep your account information accurate and up to date;
- only use an account which you are authorized to use;
- treat your Credentials as confidential and not disclose them to any other person or entity;
- not allow any other person or entity to use your account;
- notify MPI immediately of any actual or suspected unauthorized access to, or use of your account or Credentials, or any other breach of security;
- not create any duplicate accounts;
- not impersonate another person, organization, or account in the use of the Site;
- only perform transactions you are authorized to perform;
- only access Information for which you have authorization or explicit consent to access;
- not access or use any part of the Site that is (expressly or implicitly) not intended for your use;
- only change information you are authorized to change, and only make accurate changes;
- not post, transmit, link to or otherwise distribute any material or information that MPI deems to be false, inappropriate, defamatory, indecent, offensive, unlawful, or that in any way infringes the rights of others;
- not remove or obscure the trademark, copyright, or other notices displayed in the Information or on the Site;
- not copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code of the Information or Site;
- not use web scraping, web harvesting, or web data extraction methods to extract data from the Site;
- not collect or harvest any Information from the Site in a bulk or systematic way, or for marketing or research purposes, or to prospect for clients;
- not use the Site to train or create any artificial intelligence technologies;
- not create competitive works of the Information or Site;
- not attempt to create and/or distribute malicious programs (e.g., viruses, worms, Trojan horses, email bombs, scrapers etc.) in or through the Site; and
- not use the Site in a manner that harms the Site, the Site’s users or any other person, MPI, or any of MPI’s systems.
IRP Consultants
If you have granted power of attorney authorizing an IRP consultant to conduct transactions on your behalf, all transactions must be initiated by your IRP consultant and you will not be able to initiate new transactions. You will still be able to access, view and inquire about transaction information, make payments, and print documents.
Users With Additional Responsibilities
Certain users may be granted additional features and abilities on the Site. These users may be responsible for inviting and granting access to their organization’s users and maintaining their organization’s information on the Site. These users shall:
- only invite, create, and authorize users that are authorized to access their organization’s information on the Site, and are responsible for such users’ use of the Site;
- only send email invitations, or other electronic messages generated from the Site, to people they already have documented consent from to send electronic messages;
- accurately maintain their organization’s current information, and their organization’s users’ current information on the Site;
- immediately remove access to its users that are no longer permitted to access their organization’s information or the Site (For example: when an employee no longer works for the organization); and
- Comply with all other requirements of their user designation;
User Feedback
All information submitted to MPI regarding the Site or MPI’s services, including but not limited to email communications, feedback data, questions, comments, suggestions, corrections and bug fixes, and any other communications of any sort (collectively, “Feedback”), shall be deemed to be, and shall remain, the property of MPI. Subject to the below Privacy Statement , MPI will be free to use any Feedback, and will be free to use, reproduce, disclose, exhibit, display, transform, adapt, create derivative works of, and distribute the Feedback to others for any purpose whatsoeverwithout compensation to you.
Privacy Statement
The confidentiality of your personal information and personal health information is important to MPI. MPI is governed by, and adheres to, the provisions of The Freedom of Information and Protection of Privacy Act (Manitoba) and The Personal Health Information Act (Manitoba). Any personal information or personal health information received by MPI as a result of your visit to or use of the Site or any Post you submit will be kept confidential to the extent permitted by law.
MPI collects statistical data by using tools to gather information about usage of this Site. The information collected is aggregate data only and does not identify specific individuals. The information is collected for the following purposes:
- Security purposes;
- Statistical and research purposes;
- To help MPI make the Site more useful to visitors; and
- For marketing purposes.
In order for the Site’s components to function efficiently, and as well as for the purposes described above, MPI makes use of pixel-tracking and cookies when you visit the Site.
MPI is committed to protecting the privacy of your personal information and personal health information, however, you acknowledge that, absent encryption, the Internet is an inherently insecure medium of communication such that privacy cannot be ensured. MPI will therefore not be responsible for damages of any kind that you or any other persons may suffer as a result of any loss of confidentiality or your use of the Site. MPI is not responsible for the security of the device, browser, and network that you are using to access the Site.
Internet-based email is particularly vulnerable to interception and unauthorized alteration. MPI will not be responsible for damages you or any other persons may suffer as a result of a transmission of confidential information that you expressly or impliedly authorize MPI to make, or for any errors in, or changes made to the transmitted information. MPI cannot guarantee or warrant the security of any information you transmit to or from the Site, and you do so at your own risk. Once MPI receives your transmission, MPI will take all reasonable steps to protect its security on our systems.
The Site may disclose personal information or personal health information to you. MPI reminds you that it is disclosing this Information pursuant to the provisions of The Freedom of Information and Protection of Privacy Act (Manitoba) and The Personal Health Information Act (Manitoba).
Monitoring Your Use of the Site
Your use of the Site may be monitored at any time, with or without notice, by MPI. MPI reserves the right to log and monitor network traffic for security events, which may include accessing any data traversing the Site.
User and Site Access Restriction
MPI may approve, block, restrict, and/or terminate any organization’s or user’s complete or partial access to the Site, or complete or partial use of the Site, at any time for any reason.
No Endorsement of Third Parties
The Site may contain links to websites or applications independently developed by parties other than MPI (a “Third-Party Location”). In providing links to a Third-Party Location MPI does not:
- control the content of the Third Party Location;
- assume any responsibility for the accuracy or appropriateness of the information contained at the Third Party Location;
- act as a publisher or disseminator of the material contained at the Third-Party Location;
- endorse the Third-Party Location or information, products, or services; or
- assume responsibility for any loss or damage arising out of your use of the Third-Party Location.
It is your responsibility to ensure that you review and agree to any terms and conditions of use of the Third-Party Location before using them.
No Advice or Warranties
Information provided on the Site is believed to be reliable at the time it is posted. MPI does not, however, guarantee the quality, accuracy, completeness, or timeliness of the Information provided. MPI assumes no obligation to update the Information. Information contained on the Site may contain errors. Information provided may be changed without notice. Access to this Site is provided on an “as is” and “as available” basis. You should not assume that the Site will be error-free or that the Site will operate without interruption. MPI is not liable to compensate you for any Information or Posts that you may find undesirable or objectionable, or for any downtime or inaccessibility to the Site.
Computer Viruses
While every effort is made to ensure that the Information and the Site do not contain computer viruses, you should take reasonable and appropriate precautions to scan for computer viruses, and you should ensure that you have a complete and current backup of the data on your computer system prior to using the Site.
No Liability
MPI is not and will not be responsible for any direct, indirect, special, incidental or consequential damages, or any losses, damages, costs, causes of action, claims, liabilities or demands of any kind with respect to any injury to persons (including, without limitation, death), damage to or loss of property, economic loss or infringement of rights (including, without limitation, privacy rights) caused by, or arising directly or indirectly from the use of the Site, or in reliance on the Information available on the Site, or for restricting you or your organization’s use or access of the Information or Site in whole or part, or for any Posts on the Site. MPI disclaims any liability for unauthorized use or reproduction of any portion of the Site or Information.
Your Indemnification of MPI
You agree to defend, indemnify, and hold MPI harmless from all losses, damages, costs, causes of action, claims, liabilities, or demands of any kind with respect to any injury to persons (including, without limitation, death), damage to or loss of property, economic loss, or incidental, or consequential damages, or infringement of rights (including, without limitation, privacy rights) caused by, or arising directly or indirectly from your use of the Site or the Information, your Posts, or your violation of these Terms of Use.
Applicable Law
The laws of the Province of Manitoba and the laws of Canada will govern the interpretation, validity, and effect of these Terms of Use, notwithstanding any conflict of laws provision of your domicile, residence, or current physical location. You consent to and submit to the jurisdiction of the courts of the Province of Manitoba in any action or proceeding instituted under, or related to, these Terms of Use.
Invalidity
If, for any reason, one or more terms and conditions of these Terms of Use are found by a court to be void, voidable, or otherwise unenforceable, that finding will not affect the validity of the remaining terms and conditions.
Waiver
The failure of MPI to insist upon or to enforce strict performance of any provision of these Terms of Use shall not be construed as a waiver of that, or any other, provision or right. To be binding upon MPI, any waiver must be in writing and must be signed by one or more of its duly authorized representatives.The waiver by MPI of a breach of any provision of these Terms of Use shall not operate as, or be construed as, a waiver of any subsequent breach thereof.
Additional Terms
These Terms of Use are in addition to any other applicable legal terms or agreements you or your organization has with MPI. In the event of an unintended inconsistency between a term of these Terms of Use and a term of another agreement, these Terms of Use shall prevail in relation to your use of the Site.
